Article 86. Mutatis Mutandis Application of Provisions Concerning the General Meeting of Establishment.

(Compare Article 183 of the former Commercial Code)

The provisions of the Article from 67 to 71, Article 72. (Number of Votes), Paragraph 1 and Article 74. (Proxy Exercise of Voting Rights) to Article 82. (Abbreviation of Resolutions of the General Meeting of Establishment) shall apply mutatis mutandis concerning the general meeting of establishment of classes. In this situation, the “establishment shareholders” of Article 67. (Decisions on Calling the General Meeting of Establishment), Paragraph 1, item 3 and 4 as well as Paragraph 2, Article 68. (Notice of Calling of General Meeting of Establishment), Paragraphs 1 & 3, Article 69. (Abbreviation of Convocation Proceedings) through Article 71. (Reference Documents and Vote Exercise Documents), Article 72, Paragraph 1; Article 74, Paragraphs 1, 3 and 4; Article 75. (Exercise of Voting Rights by Document), Paragraph 2, Article 76. (Exercise of Voting Rights by Electromagnetic Methods), Paragraphs 2 & 3; Article 77. (Disunited Exercise of Voting), Article 78. (Explanation Duties of Incorporators), and Article 82. (Abbreviation of Resolutions of the General Meeting of Establishment), Paragraph 1, shall be reread “establishment shareholders of class,” (meaning establishment shareholders of shares to be issued at the time of incorporation of a certain class.”)
